The Secondary Employment Unit (SEU) oversees and manages the approval process for private and public employers who hire off-duty San José Police Officers and Reserve Officers.

What SEU Does:

  • Ensures employers have the required permits and meet regulatory requirements.
  • Makes sure all off-duty work follows the San José Municipal Code and other local, state, and federal laws.
  • Conducts periodic on-site inspections of secondary job locations.
  • Coordinates off-duty officer staffing for City-sponsored events like:
    • Parades
    • Festivals
    • Special events
  • Manages the Secondary Employment Insurance Premium Payment Plan, collecting liability insurance payments from participating officers.

Program Objectives

  1. Process and approve Secondary Employer applications.
  2. Process and approve Secondary Employee (officer work permit) applications.
  3. Conduct inspections of job sites and ensure compliance with Secondary Employment regulations by both employer and employee.
  4. Coordinate and track the number of hours and events which employ off-duty uniformed officers for City-sponsored events (parades, festivals and other special events) and other private events.
  5. Coordinate and monitor the collection of funds from participating officers for the Secondary Employment Insurance Premium Payment Plan (liability insurance).
  6. Monitor the cost of providing Secondary Employment capability.

Program Regulations

  1. Department members will refer all requests from potential Secondary Employment Employers to the Secondary Employment Unit. It is the responsibility of Secondary Employment Unit to conduct preliminary interview and to ensure potential employer abides by rules of the program.
  2. Officers working a uniformed secondary employment assignment are prohibited from accepting cash payment for their services. Any exception requires approval from Unit Commander in the Secondary Employment Unit.
  3. Secondary employers are required to issue appropriate tax documents to pay job employees. Secondary Employment Unit can provide the IRS form W9 for officers who work for a Secondary Employment Employer.
